Jess - Ghost Writer

Hi there - I'm Jess (27 female). I have been asked to help write a factual book. This is taking up a lot of my time and I'm confused as to who gets credit for the book and copyright? Do we have to sign an agreement to become co-authors? I hope you can help.

I do not know either (I would suggest you re-post this in Writing Tips and Advice or something of the sort); perhaps a lawyer would be better suited.

Jess -

Hello and welcome to WF. There is a wealth of information on the internet (as well as in Writing Reference works) on Collaborative Writing.

I did a basic google search and here are some links that will benefit you concerning Collaborative Writing:

http://www.writerswrite.com/journal/jun02/edwards4.htm

http://en.wikipedia.org/wiki/Collaborative_writing

Hope this helps.

Timothy

Hello there Jess! I think it would mainly depend on the agreement which is made up. Let me give you an example: if you write a book together with a well-known author, this one would get most out of the deal and on the cover of the book your name would only be in small letter type, while his/hers would be in big letters. But if both authors are equal to each other, they should get equal shares in royalties, in my opinion!

jess...
...if you are ghost-writing, you get no credit and are only paid for the job as agreed... even if s/he didn't contribute a single word, your name will not appear anywhere and the by line will be:

by Joe Doakes

...if you are writing for the person as a 'with' arrangement, then your name goes under the person who's paying you:

by Joe Doakes

with Jess Smith

...in both cases, the copyright belongs to the person who paid you, as it's a 'work for hire' and not a collaboration, unless your contract says otherwise...

...in a true collaboration, copyright ownership is shared by the co-authors and both names appear, with the person whose story it is, usually going first:

by Joe Doakes and Jess Smith

...the most important thing is to have a contract in place before you write a single word! ...go to the writers guild site for sample contracts and all the pertinent info on sharing credit, ghosting, etc.... writer's market also has a lot of good info on the subject, along with suggested payment amounts and schedules...

www.wga.org
www.wgae.org
www.writersmarket.com

...you should really consult a literary attorney before going any further... it will save you a lot of time, money, and hassle later on... if you have any other questions or need any help, feel free to email me any time...

love and hugs, maia
