Fanfiction is pretty much always a form of plagarism.
|
I wouldn't call fanfic plagiarism as such. It might be technical, but you aren't knocking off writing there, just violating copyrights to characters, etc.
One test for that premise: why would it be plagiarism to write an original Harry Potter short story, but not to write one involving Robin Hood or Hamlet? The difference is a legal statute. Plagiarism represents a deeper level of appropriation, I would say.

Fanfiction isn't plagarism because they're always presented as fanfics and the writer never claims to be the creator of the work which the fiction is based off of. Even if it wasn't, no one's going to believe the creator would post the story on the internet rather then make it cannon.

it's more 'copyright infringement'... and still not really legal, though most originators of the characters/situations won't bother taking action against the perps, unless they're selling their stuff... and most of it is so bad, who'd buy it?...

I qoute 'Dead Poets Society' the movie in 'My Verse'. Does that border on plagiarism in your eyes? Should I put a link to the IMDB? Comments??

what's the quoted material?... do you do it as a quote, or just use the line as if it's your own?... why would a link to imdb be necessary?

To plagiarise is to steal an 'original' idea/concept/term. Or to rewrite one that reads too similar.
Therefore, using generic terms such as a troll, imp or ogre in your story is not copyright. However lets say you had imps that belonged to each house and they did the washing, cleaning etc. This would be plagiarism of the house-elf idea idea from Harry Potter.
Whereas if you made your imps into problems, like an infestation of rats, this is not plagiarism. You take an idea/concept from another novel and then twist it completely.

[quote=RustyHicks;912960]I am glad to see this forum has a protection policy for its writers. quote]
I didn't see a protection policy for writers on this forum. Can you clarify? I'm just curious. All of my work is copyrighted and has been for years. I've posted a couple of new things on this forum but they're variations on things I've written before that were copyrighted years ago. I'm just curious as to how this site can truly offer protection to its writers. Thanks for your comments.

it can't... if you post your work in public anywhere on the net, anyone can do anything they want with it and you can't stop them... all you can do is sue them after the fact... which is why it's best to never post an entire piece of work... an excerpt is enough with which to get feedback on your writing quality... and stealing an excerpt won't do anyone any good...

Just a couple of day's ago, I realized I had unintentionally copied a sentence from the book Wolf Brother.

It's not so much a policy as a place that is not viewable by the general web-masses just passing through.
The Writer's Workshop. It's a members only section of WF. If you aren't signed in, you can't see it.
There are no guarantees of protection when you post your work on a public forum so be smart about it and don't post your work in its entirety. It's that simple. Only you can protect your work fully.

public domain?
Could someone remind me, from what year are certin writings in public domain? I use old fairy tales, some also printed in Andrew Lang's books. This is not plagiarism, as everyone has the right to write a new version of the Frog Prince, etc.

It depends on the year it was written and/or published.
This might give you a better understanding.
If you're not in the US, google 'Public Domain [insert your country's name here]'
